1. Introduction and Acceptance of Terms

PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE USING THIS WEBSITE OR MAKING A BOOKING.

These Terms and Conditions (“Terms”) govern your access to and use of the Scubahive website, applications, and related services (collectively, the “Site” or “Services”).

By accessing, browsing, or using the Site, or by completing a booking, you confirm that you have read, understood, and agreed to be bound by these Terms. If you do not agree, you must refrain from using the Site.

Scubahive may amend these Terms from time to time. Updated Terms will be posted on the Site and will take effect immediately upon posting. Continued use of the Services constitutes acceptance of the updated Terms.

Please also refer to our Privacy & Cookies Policy, which forms part of your use of the Services.

2. Definitions

  • Scubahive”, “we”, “us”, “our” refers to the operator of Scubahive.com.
  • User” or “you” refers to any person who accesses or uses the Site or Services.
  • Service Provider” refers to third-party providers including dive operators, resorts, insurers, and related partners offering services via the Site.
  • Booking” refers to any reservation, purchase, or confirmed arrangement made through the Site.

3. Nature and Scope of Scubahive's Services

Scubahive operates an online platform that connects Users with Service Providers offering scuba diving–related experiences and services.

Scubahive:

  • Acts solely as a platform and booking facilitator
  • Does not provide diving services itself
  • Is not a travel agency, dive operator, or tour provider

All Bookings constitute a direct contract between the User and the relevant Service Provider, subject to the Service Provider’s own terms and conditions.

Scubahive does not endorse, guarantee, or warrant the quality, safety, suitability, legality, or availability of any Service Provider or any services provided by them.

Information displayed on the Site is based on information provided by Service Providers. Scubahive does not guarantee that such information is accurate, complete, or error-free, and reserves the right to update or correct information where appropriate.

Scubahive may display listings in an order determined by objective factors (for example, popularity, availability, relevance, or other ranking criteria). Display order does not constitute an endorsement.

4. Eligibility and User Responsibilities

By using the Site, you represent and warrant that:

  • You are at least 18 years old and legally capable of entering binding agreements
  • All information you provide is accurate, complete, and up to date
  • You will comply with these Terms and all applicable laws and regulations

You agree not to:

  • Make false, speculative, or fraudulent Bookings
  • Use the Site for commercial or competitive purposes
  • Scrape, copy, resell, deep-link, or otherwise misuse Site content
  • Post unlawful, offensive, defamatory, misleading, or infringing content

5. Personal and Non-Commercial Use Only

The Site and its content are provided for personal, non-commercial use only.

You may not reproduce, distribute, display, sell, license, or otherwise exploit any part of the Site or its content without Scubahive’s prior written consent.

6. Prices, Fees, and Scubahive Price Guarantee

Prices displayed on the Site are provided by Service Providers and may exclude:

  • Taxes
  • Service charges
  • Equipment rental
  • Local/tourism fees
  • Other ancillary charges

Additional charges may be imposed directly by Service Providers and are outside Scubahive’s control. Where applicable, fees and charges will be disclosed during the booking process.

Scubahive’s Price Guarantee applies subject to the separate Scubahive Price Guarantee policy, which forms part of these Terms.

7. Payments, Currency and Exchange Rates

Payments may be processed through third-party payment processors.

Currency conversions, exchange rates, and transaction fees are determined by your bank/payment provider and are not controlled by Scubahive. Scubahive is not responsible for currency fluctuations or bank charges.

8. Diving Requirements and Safety

By making a Booking, you acknowledge that scuba diving and related activities involve inherent risks.

You are responsible for meeting Service Provider requirements, including (where applicable):

  • Minimum certification level
  • Medical fitness and declarations
  • Liability waivers / assumption of risk forms
  • Dive insurance requirements
  • Local regulations and safety briefings

Failure to meet requirements may result in denial of service by the Service Provider without refund, subject to the applicable policies.

9. Suspension, Refusal and Cancellation of Service

Scubahive reserves the right, at its sole discretion and to the extent permitted by law, to suspend, restrict, or terminate access to the Site, or to refuse to process or give effect to any Booking request, including where:

  • The Booking appears fraudulent, speculative, or abusive
  • Required information is incomplete or inaccurate
  • Compliance with applicable laws, safety considerations, or policies cannot reasonably be ensured

Such actions may be taken without prior notice and without obligation to provide reasons.

10. Cancellations, Changes and Refunds

All Bookings made through Scubahive are subject to:

  • These Terms, and
  • The cancellation, no-show, and refund policies of the relevant Service Provider

Where there is any inconsistency, the stricter policy shall apply.

a. General Cancellation Principles

  • Some bookings may be non-refundable, as clearly stated prior to payment
  • Cancellation and amendment requests must be submitted in writing
  • Refund eligibility is assessed based on the applicable policy and the date the request is received

b. Scubahive Booking Handling Guidelines

Unless otherwise specified by the Service Provider, Scubahive may apply the following guideline framework, subject always to the Service Provider’s policy:

  • Cancellations made more than 30 days before commencement may be eligible for a partial refund
  • Cancellations made within 14–30 days may be subject to increased charges
  • Cancellations made within 14 days, failure to arrive, or no-shows are typically non-refundable

These guidelines are indicative only and do not override Service Provider policies.

c. Refund Processing

  • Approved refunds will be processed within a reasonable timeframe after verification
  • Bank fees, payment processing fees, and currency conversion charges are non-refundable
  • Refund timelines may vary depending on payment method and financial institutions

d. Changes and Amendments

Booking changes or amendments may incur additional charges and are handled on a case-by-case basis, subject to availability and Service Provider approval.

e. Unavailability and Exceptional Circumstances

If a confirmed service is unavailable and no acceptable alternative can be arranged, Scubahive may facilitate a refund in accordance with applicable policies.

In exceptional circumstances (including natural disasters, political unrest, or safety concerns), Scubahive may, at its discretion, facilitate cancellations or refunds. Scubahive shall not be responsible for ancillary costs such as flights, accommodation, or insurance purchased independently.

f. No Insurance Representation

Users acknowledge that cancellation and refund provisions:

  • Do not constitute insurance
  • Do not replace travel or dive insurance
  • Are not transferable or assignable

Users are strongly encouraged to obtain appropriate travel and dive insurance.

11. Service Provider Responsibility

Scubahive operates solely as a platform and booking facilitator that connects Users with independent Service Providers.

Each Service Provider is solely responsible for:

  • Delivering the booked services
  • Ensuring safety, compliance, and operational standards
  • Providing accurate descriptions of their offerings
  • Managing on-site experiences, staff, equipment, and facilities
  • Handling service performance, delays, substitutions, or cancellations

Scubahive does not control, manage, or operate any Service Provider’s activities and does not assume responsibility for the acts, omissions, or conduct of any Service Provider.

a. Service-Related Issues

Any issues relating to the quality, safety, delivery, or execution of services — including but not limited to dive operations, equipment, weather decisions, staff conduct, or on-site conditions — are the responsibility of the relevant Service Provider.

Users agree that such matters should be addressed directly with the Service Provider, in accordance with the Service Provider’s policies and applicable laws.

b. Scubahive's Role in Assistance

Where appropriate, Scubahive may, at its discretion:

  • Assist in facilitating communication between Users and Service Providers
  • Provide clarification of booking details or policies
  • Help escalate issues in good faith

However, such assistance does not constitute acceptance of liability or responsibility by Scubahive.

c. No Guarantee of Outcome

Scubahive does not guarantee any specific outcome, resolution, or remedy in disputes between Users and Service Providers, including claims relating to service quality, safety incidents, or dissatisfaction.

d. Regulatory and Licensing Requirements

Service Providers are responsible for maintaining required licences, permits, certifications, and insurance. Scubahive does not audit or guarantee regulatory compliance.

12. Reviews and User Content

Users may submit reviews, comments, and other content.

By submitting content, you grant Scubahive a non-exclusive, royalty-free, worldwide licence to use, reproduce, publish, and display such content in connection with the Services.

Scubahive reserves the right to moderate, edit, or remove content at its discretion.

13. Intellectual Property

All intellectual property rights in the Site (including content, branding, design, layout, and software) belong to Scubahive or its licensors.

You may not use Scubahive’s trademarks, branding, or content without prior written consent.

14. Third-Party Links

The Site may contain links to third-party websites. Scubahive is not responsible for third-party content, policies, or practices.

15. Disclaimer

THE SITE AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE”.

Scubahive disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.

16. Limitation of Liability

To the maximum extent permitted by law:

  • Scubahive shall not be liable for indirect, incidental, special, or consequential damages
  • Scubahive’s aggregate liability shall not exceed the amount paid to Scubahive (if any) for the relevant Booking

Nothing in these Terms limits liability that cannot be excluded under applicable law.

17. Indemnity

You agree to indemnify and hold harmless Scubahive from claims, losses, liabilities, damages, and expenses arising from:

  • Your use of the Site
  • Your breach of these Terms
  • Your dealings with Service Providers

18. Force Majeure

Scubahive shall not be liable for any failure or delay in performance due to events beyond reasonable control, including but not limited to natural disasters, severe weather, government actions, pandemics, or political unrest.

Users are encouraged to obtain travel and dive insurance.

19. Termination

Scubahive may suspend or terminate access to the Site as permitted by law.

Sections intended to survive termination (including disclaimers, limitation of liability, and indemnity) shall remain in effect.

20. Governing Law

These Terms are governed by the laws of Malaysia, without regard to conflict-of-law principles.

21. Dispute Resolution

Any dispute arising out of or relating to these Terms shall be resolved through binding arbitration, except where injunctive relief is required to protect intellectual property rights.

To the extent permitted by law, you waive the right to participate in class actions or representative proceedings.

22. Severability

If any provision is held unenforceable, the remaining provisions remain in full force and effect.

23. Entire Agreement

These Terms constitute the entire agreement between you and Scubahive regarding use of the Site and Services and supersede prior agreements relating to the same subject matter.
